Jasen Gundersen, MD, CEO of CardioOne, wrote an article recently for MedCity News on “Forging a Noncompete Policy That Works for Healthcare.” The lawsuit that stopped the Federal Trade Commission’s effort to ban noncompete clauses in its tracks gives healthcare leaders the chance to define a federal noncompete policy that works for patients, physicians and provider organizations, Dr. Gundersen wrote. He described four tenets of a noncompete policy that minimizes the disruption to patients:
- Applies to not-for-profits and for-profits alike
- Requires including a buy-out clause for physicians
- Sets a time limit
- Requires provider organizations to provide patients with details about the physician’s next practice home if the physician satisfies either the buy-out clause or the time limit.
